Neighbour's hedge over your fence: what you can and cannot cut
The basic rule: you can trim back to the boundary
In New Zealand you are generally entitled to cut branches and roots that cross onto your property, back as far as the boundary line, at your own cost and without asking permission. That is the starting point most people already half know. The complications are all in where that right stops.
Where the right stops
- The boundary is the limit. You cannot reach over and cut on their side, and you cannot enter their property to do it without permission.
- You must not damage or kill the tree. Trimming to the boundary is fine. A cut so severe that the tree dies or is badly damaged can leave you liable.
- The clippings are not yours. Branches you cut, and any fruit on them, legally belong to the tree's owner. The polite and correct move is to offer them back rather than keeping them or lobbing them over the fence.
- Check for protection first. Some trees are protected under the district plan, and cutting a protected tree can be an expensive mistake. Check with Christchurch City Council before touching anything significant.
Talk first. It is genuinely cheaper
Almost every hedge dispute resolves faster over the fence than through any formal process. Most people simply have not noticed the problem, or have been putting off a job they cannot easily do themselves. Offering to split the cost of a proper trim is often cheaper than a single hour of anyone's legal time, and it means the whole hedge gets shaped rather than one flat face on your side, which looks decidedly odd.
When talking does not work
If a tree is causing real problems, damaging structures, dropping dangerous limbs or seriously blocking light, the Property Law Act 2007 allows an application to the District Court for an order to trim or remove it. The court weighs the hardship to you against the hardship to your neighbour, so this is a last resort rather than an opening move. This is general information, not legal advice.
